TERMS OF SERVICE

Welcome to Playoff Predictors ("Playoff Predictors", "we", "us", or "our"). By accessing or using any part of playoffpredictors.com, v2.playoffpredictors.com, or any related subdomain, API, or service (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. The Service

Playoff Predictors is a free, public website that lets visitors pick the outcomes of regular-season and postseason games for several professional and collegiate sports leagues, computes standings and playoff seeding based on those picks, and allows users to share predictions. Most features work without an account.

2. "As Is" — No Guarantee of Accuracy

The Service is provided on an "as is" and "as available" basis, for entertainment and informational purposes only. We implement each league's tiebreaker rules as faithfully as the available data allows, but we make no warranty, express or implied, that results, standings, seedings, or predictions are complete, accurate, current, or free from error. Nothing on the Service constitutes professional, financial, or wagering advice. Do not rely on the Service for betting or other decisions with real-world consequences.

3. Accounts

You may optionally create an account to unlock features such as saving brackets and joining pools. You are responsible for the security of your credentials and for all activity under your account. You must provide accurate information and promptly update it if it changes. You may delete your account at any time from the Account Settings page in the Playoff Predictors web app.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to disrupt, overload, or degrade the Service or any connected infrastructure.
  • Probe, scan, or test the vulnerability of any system or network, or breach or circumvent any security or authentication measures.
  • Upload or transmit malicious code, spam, or content that is defamatory, obscene, harassing, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation with one.
  • Use the Service to infringe the intellectual property, privacy, or other rights of others.

5. Automated Access and API Use

The Service's backend APIs are intended for use by our own first-party applications (including the public website and its official clients). Unauthorized automated access is prohibited. Without our prior written consent, you may not:

  • Access, call, or consume any non-public or undocumented API, endpoint, or internal service.
  • Scrape, crawl, harvest, or otherwise extract data from the Service in bulk or by automated means.
  • Reverse-engineer, decompile, or attempt to derive the source of our APIs, data models, tiebreaker algorithms, or protected client code, except to the limited extent such activity is permitted by applicable law.
  • Use bots, spiders, or any similar tooling to interact with the Service beyond the normal operation of a standard web browser by an individual end user.
  • Resell, redistribute, or republish data obtained from the Service without our permission.

We reserve the right to rate-limit, block, or disable access from any IP address, user agent, or account we reasonably believe is engaged in unauthorized automated access, and to pursue any available remedies for such activity.

6. Content Moderation Policy

  • Content moderation policy applies to all user-submitted names (pool, league, team, display) and image uploads.
  • Image uploads found to violate the policy result in permanent loss of upload privileges across all custom leagues for that user account.
  • League purchases are non-refundable when an account is restricted under this policy.
  • Determinations are made by automated content moderation backed by admin review; appeals require contacting admin@playoffpredictors.com.

7. Your Content

When you submit content to the Service — including picks, brackets, league names, pool names, team names, team logos, uploaded images, comments, or any other material ("User Content") — you retain ownership of that content. You grant Playoff Predictors a worldwide, non-exclusive, royalty-free license to host, display, reproduce, modify (including resizing or reformatting), and distribute that content for the purpose of operating and promoting the Service. You represent that you have the rights necessary to grant this license and that your User Content does not violate any law or third-party right.

Uploaded Images

If you upload images to the Service (for example, custom team logos), you represent and warrant that: (a) you own or have obtained all necessary rights to that image; (b) the image does not infringe any third-party copyright, trademark, right of publicity, or other intellectual-property right; and (c) the image does not contain unlawful, defamatory, obscene, harassing, or otherwise objectionable content. We reserve the right to remove any uploaded image at our sole discretion without notice.

Copyright Complaints (DMCA)

If you believe that content on the Service infringes your copyright, please send a notice to our designated DMCA agent at ray@playoffpredictors.com with the following information: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the infringing material and its location on the Service; (3) your contact information; (4) a statement that you have a good-faith belief that the use is not authorized; and (5) a statement under penalty of perjury that the information is accurate and that you are the copyright owner or authorized to act on their behalf. We will respond to valid notices in accordance with the DMCA.

8. Intellectual Property

The Service — including its design, code, text, graphics, logos, and underlying tiebreaker and standings logic — is owned by Playoff Predictors or its licensors and is protected by copyright, trademark, and other laws. Team names, league names, and logos are the property of their respective owners and are used for identification and descriptive purposes only; use of those names and logos on the Service does not imply sponsorship or endorsement by any league or team. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted by these Terms or by applicable law.

9. Third-Party Links and Services

The Service may contain links to third-party sites, services, and integrations (for example, Discord, X, payment processors, and sports data providers). We do not control those third parties and are not responsible for their content, practices, or availability. Your use of any third-party service is governed by that service's own terms and policies.

10. Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.

11. Limitation of Liability

To the fullest extent permitted by law, in no event will Playoff Predictors, its operators, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service, whether based in contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim relating to the Service will not exceed USD $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless Playoff Predictors and its operators from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party right.

13. Suspension and Termination

We may suspend, restrict, disable, or terminate your account or your access to the Service, in whole or in part, at any time and for any reason — or for no reason — in our sole discretion, with or without prior notice. Reasons include, without limitation:

  • Actual or suspected violation of these Terms, our Privacy Policy, or any policy, guideline, or notice we publish for the Service.
  • Conduct we consider abusive, deceptive, fraudulent, harassing, or harmful to other users, the Service, or our operators, whether or not it also violates the law.
  • Any automated, excessive, or otherwise unauthorized access to the Service.
  • Actions we believe in good faith expose us, our operators, or other users to legal, reputational, financial, or operational risk.
  • Requirements imposed by law, regulation, court order, or a request from a governmental, law-enforcement, or payment-processing authority.
  • Any other reason we determine in our sole discretion, including decisions to discontinue, rebuild, or restructure the Service.

We are not obligated to provide a reason for a suspension or termination, and we may do so without warning. You waive any claim arising from an account suspension or termination permitted by this section to the fullest extent allowed by law.

You may delete your account at any time from the Account Settings page in the Playoff Predictors web app, or by emailing dpo@playoffpredictors.com. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

14. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will update the "Effective" date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of those Terms.

15. Governing Law

These Terms are governed by the laws of the United States and the State of Colorado, without regard to conflict-of-laws principles. Any dispute arising out of or related to the Service or these Terms will be resolved exclusively in the state or federal courts located in the State of Colorado, and you consent to personal jurisdiction and venue in those courts.
